These Terms govern access to and use of BOTIA, including the free scan allowance and paid annual access. By using BOTIA, you agree to these Terms.
1. Who provides BOTIA
BOTIA is operated by ServiceHub, Kolvelseweg 165, 5025 JD Tilburg, Netherlands. KvK 42023784. VAT number NL005436838B84. Contact: soporte@botia-safefood.com.
2. What BOTIA is
BOTIA is a food-label transparency service. It reads declared food ingredients and connects them with published scientific, regulatory and transparency information. BOTIA is an informational tool. It does not certify food, issue halal certification, provide medical or nutritional advice, diagnose health conditions, or tell users what they should eat.
3. Free access
BOTIA may provide up to five free scans before paid access is required. Free access is intended to let users try the service and may be subject to technical or anti-abuse controls.
4. Paid annual access
Paid BOTIA access is offered on an annual basis at the price shown at checkout for the user’s country, currency and payment channel. The checkout price shown before purchase is the applicable price for that transaction. Paid access includes up to 300 scans per month during the active paid period.
5. Renewal and cancellation
Annual access is sold as a recurring annual subscription. Unless cancelled before the next renewal date, the subscription renews automatically for another annual period at the renewal price shown by the relevant payment channel. Cancelling stops future renewal; access already paid for remains available until the end of the current paid period, subject to these Terms.
6. Payments, taxes and payment providers
Payments may be processed by third-party payment providers or platform stores. Before payment is completed, the checkout shows the amount to be charged in the applicable currency and any taxes or charges that must be shown separately. Where a payment provider or platform acts as merchant of record, that provider or platform is responsible for the payment transaction and for collecting and remitting transaction taxes within the scope of its role. Purchases may also be subject to the payment provider’s or platform’s own terms.
7. Subscription access
Access rights are associated with the account or user identifier used for the purchase. BOTIA uses RevenueCat to manage subscription status and access entitlements across supported platforms. Users are responsible for using the correct account when purchasing or restoring access.
8. Scan limits and fair use
Paid access currently includes up to 300 scans per month. The limit exists to keep the service sustainable and protect it from automated or abusive use. Unused scans do not roll over unless BOTIA expressly states otherwise.
9. Accuracy and limitations
BOTIA analyses the information declared on the label presented by the user. Food formulations, labels, regulations and scientific assessments can change. BOTIA cannot guarantee that every label is complete, current or readable, or that information not declared on a label can be detected. Users should verify information that is important to health, allergy, religious, ethical or legal decisions with the manufacturer or an appropriate qualified authority.
10. Availability and changes
BOTIA may update, maintain or change the service to improve accuracy, security, performance or legal compliance. Temporary interruptions may occur because of maintenance, network failures, third-party services or circumstances outside ServiceHub’s reasonable control.
11. Prohibited use
You may not use BOTIA to:
- interfere with or attempt to bypass security, usage limits or access controls;
- use automated systems to generate excessive scans or traffic without permission;
- reverse engineer, scrape or reproduce protected parts of the service except where applicable law expressly allows it;
- use the service for unlawful, fraudulent or abusive purposes.
12. Refunds and mandatory consumer rights
Refunds, cancellation rights and withdrawal rights depend on the payment channel and the mandatory consumer protections that apply to the transaction. Nothing in these Terms removes or limits rights that cannot legally be waived. Where a purchase is made through a platform store or a merchant-of-record payment provider, refund requests may be handled under that provider’s applicable process and terms.
13. Privacy
The processing of personal data is described in BOTIA’s Privacy Policy. Payment providers and platform stores process payment data under their own privacy policies and legal obligations.
14. Intellectual property
Unless otherwise stated, BOTIA’s original texts, structure, software, design, branding and original content are owned by or licensed to ServiceHub. Third-party publications, trademarks and referenced documents remain subject to the rights of their respective owners.
15. Liability
BOTIA is provided as an informational service. To the maximum extent permitted by applicable law, ServiceHub is not liable for decisions made solely on the basis of BOTIA output where the underlying label is incomplete, incorrect, outdated, unreadable or does not declare the information concerned. Nothing in these Terms excludes liability that cannot lawfully be excluded.
16. Changes to these Terms
These Terms may be updated when BOTIA’s service, pricing, payment arrangements or legal obligations change. The current version and its date will always be published on this page. Material changes affecting an active paid subscription will be communicated where required by applicable law.
17. Applicable law
These Terms are governed by Dutch law, without prejudice to any mandatory consumer protections, choice-of-law rules or jurisdiction rights that apply to users under the law of their country or region.
